Alabama
Legal Status: Illegal, Alabama is enforcing a total abortion ban.
Restrictions: Alabama does not allow abortion at any stage, however, Alabama cannot restrict people from going to other states and getting abortion care there.
There are no expectations for rape or incest, the only exception is if the pregnant person’s life is in danger.
Contraceptives: Alabama residents can access contraceptives but it is a challenge. Plan B is available over the counter.
Other: The Alabama Supreme Court ruled that frozen embryos are children and therefore are legally protected.
Alaska
Legal Status: Abortion is protected in Alaska, in 1997 the state’s highest court recognized a fundamental right to “reproductive choice” under the Alaska Constitution.
Restrictions: Alaska law prohibits D&X procedures, but that ban is permanently enjoined.
The Alaska Supreme Court has also found that limits on public funding for abortion were unconstitutional under the state equal protection clause.
Contraceptives: Alaska residents can access contraceptives, and insurance companies must cover all FDA-approved contraceptives at no cost to the consumer. Plan B is available over the counter or at Planned Parenthood health centers.
Arizona
Legal Status: Abortion is protected in Arizona. Voters approved an amendment to the Arizona Constitution that protects abortion rights.
Restrictions: Arizona bans abortion at fifteen weeks. However, the ban is currently being challenged as unconstitutional due to the state’s constitutional amendment.
The law requires a 24-hour waiting period and counseling before an abortion, and minors need parental consent.
Contraceptives: People 18 and older can get contraceptives without a prescription at a pharmacy. Plan B is available over the counter.
Arkansas
Legal Status: Illegal, Arkansas is enforcing its trigger ban to prohibit abortion entirely.
Restrictions: It retains a total ban and gestational bans at twelve weeks.
The law requires a 72-hour waiting period, biased counseling, and an ultrasound. Minors need parental consent.
Contraceptives: Arkansas residents have access to contraceptives through pharmacists and healthcare providers. Plan B is available over the counter.
California
Legal Status: Abortion is protected in California, and the state has expanded access. California has enshrined in statute a protection for abortion as a fundamental right.
Restrictions: California law generally prohibits abortion at viability.
California has interstate shield laws protecting providers, patients, and people who help others access abortion from out-of-state civil investigations, legal actions, and civil judgments.
Contraceptives: California residents can access contraceptives, and insurance companies must cover over-the-counter contraceptives and vasectomy without cost-sharing through the Contraceptive Equity Act of 2022. Plan B is available over the counter or at Planned Parenthood health centers.
Colorado
Legal Status: Abortion is protected in Colorado. Voters approved an amendment to the Colorado Constitution that protects abortion rights.
Restrictions: Colorado law limits public funding for abortion, and it generally requires that legal guardians be notified about a minor’s abortion unless a judge approves a petition from a minor.
Contraceptives: Colorado residents have multiple ways to access contraceptives, including low-cost and free birth control. Plan B is available over the counter.
Connecticut
Legal Status: Abortion is protected in Connecticut, and the state has expanded access.
Restrictions: Connecticut law generally prohibits abortion post-viability and during the third trimester.
Connecticut funds medically necessary abortions and has interstate shield laws protecting providers, patients, and people who help others access abortion from out-of-state civil investigations, legal actions, and the disclosure of information.
Contraceptives: Connecticut residents can access contraceptives at no cost, and Connecticut law has expanded access by allowing pharmacists to prescribe birth control and installing emergency contraception vending machines. Plan B is available over the counter.
Delaware
Legal Status: Abortion is legal in Delaware and state law includes express protections for abortion.
Restrictions: Delaware law generally prohibits abortion after viability, and it generally requires that legal guardians be notified about a minor’s abortion unless a judge approves a petition from a minor.
Delaware has interstate shield laws protecting providers, patients, and people who help others access abortion from out-of-state investigations, legal actions, and the disclosure of information.
Contraceptives: Delaware residents can access contraceptives at low or no cost, and new regulations allow pharmacists to dispense contraceptives without a prescription. Plan B is available over the counter or at Planned Parenthood health centers.
Florida
Legal Status: Abortion is banned for six weeks in Florida.
Restrictions: Florida law generally prohibits abortion at six weeks.
The law requires a 24-hour waiting period, biased counseling, and an ultrasound. Minors need parental consent.
Contraceptives: Florida residents have access to contraceptives through a number of different programs. Plan B is available over the counter.
Georgia
Legal Status: Abortion is banned for six weeks in Georgia.
Restrictions: Georgia law generally prohibits abortion at six weeks.
The law requires a 24-hour waiting period and biased counseling.
A state district court found that the Georgia Constitution prohibits political interference with an individual’s abortion decision before viability and issued a permanent injunction, which the Georgia Supreme Court stayed pending the state’s appeal.
Contraceptives: Georgia residents have access to contraceptives. Plan B is available over the counter or at Planned Parenthood health centers.
Hawaii
Legal Status: Abortion is protected in Hawaii, and the state has expanded access.
Restrictions: Hawaii law allows abortion until viability.
Hawaii has interstate shield laws protecting providers, patients, and people who help others access abortion from out-of-state investigations, legal actions, and the disclosure of information.
Contraceptives: Hawaii residents can access contraceptives at low or no cost. Plan B is available over the counter, at Planned Parenthood health centers, and at gas stations.
Idaho
Legal Status: Illegal, Idaho is enforcing a total abortion ban.
Restrictions: Idaho does not allow abortion at any stage. There are exceptions if the pregnant person’s life is in danger, or cases of incest or rape.
The law requires a 24-hour waiting period and biased counseling. In 2023, Idaho enacted a law that criminalizes assistance to a minor who leaves the state to access abortion care.
Contraceptives: Idaho residents have access to contraceptives. Plan B is available over the counter or at Planned Parenthood health centers.
Illinois
Legal Status: Abortion is protected in Illinois, and the state has expanded access. The Illinois Supreme Court has recognized the right to abortion under the state’s constitution.
Restrictions: Illinois law generally prohibits abortion after viability.

Indiana
Legal Status: Illegal, Indiana is enforcing a total abortion ban.
Restrictions: Indiana does not allow abortion at any stage.
The law requires an 18-hour waiting period, biased counseling, and an ultrasound. Minors need parental consent.
The Indiana Supreme Court held that the constitution protects abortion in situations when there is a risk to a pregnant person’s life.
Contraceptives: Indiana residents have access to contraceptives. Plan B is available over the counter.
Iowa
Legal Status: Abortion is banned for six weeks in Iowa.
Restrictions: Iowa law generally prohibits abortion at six weeks.
The law requires a 24-hour waiting period, biased counseling, and pregnant people will be offered an ultrasound. Minors need parental consent unless a judge approves a petition from a minor.
Contraceptives: Access to contraceptives in Iowa has been impacted by state and federal policies, patients report not being able to get a 90-day supply. Plan B is available over the counter.
Kansas
Legal Status: Abortions are legal in Kansas.
Restrictions: Kansas law generally prohibits abortion at twenty-two weeks and post-viability.
The law requires a 24-hour waiting period and biased counseling. Minors need parental consent

Kentucky
Legal Status: Illegal, Kentucky is enforcing a total abortion ban.
Restrictions: Kentucky does not allow abortion at any stage

Louisiana
Legal Status: Illegal, Louisiana is enforcing a total abortion ban.
Restrictions: Louisiana does not allow abortion at any stage.

Contraceptives: Louisiana residents have access to contraceptives. Plan B is available over the counter.
Other: In 2023, Louisiana enacted a law that gives people a tax credit if they donate to crisis pregnancy centers or Planned Parenthood health centers.
Maine
Legal Status: Abortions are legal in Maine.
Restrictions: Maine law generally prohibits abortion after viability but, as of 2023, abortion care post-viability is allowed when a physician deems it necessary.
Minors need parental consent, however, providers can waive this consent.

Maryland
Legal Status: Abortion is protected in Maryland, and the state has expanded access. Voters approved an amendment to the Maryland Constitution that protects abortion rights.

Massachusetts
Legal Status: Abortion is protected in Massachusetts. The Massachusetts Supreme Court has recognized the right to abortion under the state’s constitution.
Restrictions: Massachusetts law generally prohibits abortion at twenty-four weeks.
Minors need parental consent if under 16 years old.

Michigan

Minnesota

Legal Status: Abortion is protected in Montana. The state’s highest court recognized “procreative autonomy” under the Montana Constitution, protecting the right to abortion.

Nebraska
Legal Status: Abortion is banned for twelve weeks in Nebraska.
Restrictions: Nebraska law generally prohibits abortion at twelve weeks, except to save the life of the pregnant person, or in cases of sexual violence.
The law requires a 24-hour waiting period and biased counseling, and pregnant people will have an ultrasound at least 1-hour before the operation if available. Minors need parental consent.
Contraceptives: Nebraska residents have access to contraceptives. Plan B is available over the counter.
Nevada
Legal Status: Abortion is protected in Nevada. Voters approved an amendment to the Nevada Constitution that protects abortion rights in 2024, which requires a second vote in 2026 to be effective.
Restrictions: Nevada law generally prohibits abortion at twenty-four weeks.
Minors need parental consent.
Contraceptives: Nevada residents have access to contraceptives. Plan B is available over the counter.
New Hampshire
Legal Status: Currently legal but does not have any legal protection.
Restrictions: New Hampshire law prohibits abortion at twenty-four weeks, and an ultrasound is required if a pregnancy is believed to be twenty-four weeks.
Minors need parental consent unless a judge approves a petition from a minor.
Contraceptives: New Hampshire residents can access contraceptives at low or no cost. Plan B is available over the counter or at Planned Parenthood health centers.
New Jersey
Legal Status: Abortion is protected in New Jersey, and the state has expanded access.
New Jersey enacted a statutory protection for abortion as a fundamental right and the state’s highest court recognized the “fundamental right of a woman to control her body and destiny” under the New Jersey constitution.
Restrictions: The legislature has not repealed a requirement that a parent or legal guardian be notified about a minor’s abortion, but it was held as unconstitutional under the state’s constitution.
Contraceptives: New Jersey residents have access to contraceptives. Plan B is available over the counter.
New Mexico
Legal Status: Currently legal but does not have any legal protection.
Restrictions: New Mexico law prohibits D&X procedures.
Contraceptives: New Mexico residents can access contraceptives at low or no cost. Plan B is available over the counter or at Planned Parenthood health centers.
Other: On August 31, 2022, the New Mexico governor issued an executive order that provides $10 million to develop a new abortion clinic near the state’s southern border with Texas

Pennsylvania

Restrictions: The law prohibits abortion at twenty-four weeks.
The law requires a 24-hour waiting period and counseling before an abortion, and minors need parental consent. However, emancipated minors do not need parental consent.
Pennsylvania has an executive order designed to protect people seeking reproductive health care services in Pennsylvania and medical professionals offering those services from other states.

Rhode Island
Legal Status: Abortion is protected in Rhode Island.
